  • The facility was in violation of maximum occupancy according to the fire marshal. Max occupancy is 26 and there were 36 people in the facility: 26 patients, 2 surveyors and 8 staff;
  • Facility failed to report their ITOP (Induced Termination of Pregnancy) numbers to the state in the required 15 days. None of the reports were signed by the physician, they were all stamped and this is a violation.
  • There was no informed consent signed by the patient for her abortion procedure.
  • The Induced Termination of Pregnancy Report that is sent to the state for oversight did not contain accurate information
  • No registered nurse on staff at the facility as required by the state
  • Staff failed to give the full required informed consent information to patients before their appointment, i.e. abortion alternatives and links to mental health counseling
  • The medical director who procured/ordered controlled substances did not have a Controlled Dangerous Substance license.
  • Failed to ensure an annual review of written policies was done to ensure the products of conception are disposed of in compliance with OSHA, EPA and the law.
  • Facility had unlicensed staff member with no documentation of ultrasound training or surgical tech training.
  • Abortion procedure performed on 15-year-old with no notorized form of legal guardian’s knowledge as required.
  • 2 rolling tables with instruments and supplies not covered or in a container found with blood and body fluids.
  • Rust found on exam table
