Health Violations

  • The staff failed to report the sexual abuse/neglect of a minor.  A 14 year old girl came in on 4/12/14 for an abortion, she has 2 living children. No report made. The SAME girl comes in on 8/18/14 for ANOTHER abortion. No report made.
  • No ultrasound (as required by law) prior to procedures in 17 of 24 charts
  • Failed to maintain accurate records (no documentation of meds given)
  • Staff failed to contact a patient when pathology report indicated that her abortion procedure was not complete.  Pt ended up in the ER with abdominal pain and called the clinic complaining that she is “still pregnant” and ultrasound in the ER revealed it is a “continuing pregnancy”.  In other words, her baby is alive.
  • The last documented review of the policy and procedure by clinic staff was as follows:
    • Physician – last review 3/01/14
    • Nurse – last review 5/16/14
    • Health Center Manager – 11/2014
    • Health Center Assistant – 2/05/15
  • There was no documentation to show clinic staff had completed the annual policy review.
  • The physician had no annual review of competency to ensure she is competent to perform abortions.
  • The surveyors reviewed 12 medical records of patients who completed an abortion procedure and failed to receive the name of the physician who would respond to an emergency complication and the name of the medications received at the clinic on their discharge paperwork.
  • The clinic failed to assure all staff completed hand washing appropriately. This had the potential to affect all patients served.
  • Four of four fire extinguishers in the facility failed to have documented monthly inspections.
  • The clinic failed to assure preventive maintenance (PM) was completed for all patient used equipment.
  • Expired medications and supplies in use.
  • Failure to ensure a policy for physician qualifications including observation of clinical skills
