Clinic is Open/Referring/Performing Abortions

  • Staff failed to obtain a proper informed consent for surgical abortion on 7 of 8 medical records reviewed
  • There was no RN on duty documented on all 10 daily abortion procedure logs reviewed. It is a requirement that an RN be on staff when abortions are performed.
  • Expired medications were in use (Lidocaine and Epinephrine)
  • The medical director failed to ensure that an RN was in the building at all times during procedures for 59 of 97 procedure days.
  • The staff failed to obtain a written physician’s order for medications administered
  • Staff did not receive an annual review for competency and their records had no updated job descriptions. Last review was 2 years prior to this inspection
  • Staff did not receive a TB skin test. This had the potential to affect all staff and patients in the facility.
  • Unlicensed, unqualified staff performing clinical duties
  • Staff took away the curtains in the recovery area, leaving patients without any privacy barriers.
